The purpose of filing a Personal Property Foreclosure is to recover personal property where there has been a violation of the terms of a lease or a security agreement. This process is used to obtain possession of collateral or leased property and to foreclose the debtor's interest in collateral.
When filing an Affidavit/Petition for a Personal Property Foreclosure, please be sure to adhere to the following instructions. Should you have any questions regarding this process, please contact the Clerk's office at 404-613-5040/5041.

Submit one (1) original and two (2) copies a completed Personal Property Foreclosure Affidavit.
- Submit three (3) copies of the contract and/or written agreement.
- Complete one Foreclosure Marshal's Entry of Service form for each defendant to be served.
- Once the affidavit is served, the defendant has 14 days to respond, in writing, to the court.
- • If a response is made by the defendant, a court date will be given and each party would need to personally appear unless the case is settled/dismissed prior to the court date.
