Fulton County Task Force Recommends Improvements for the Courts

Effective July 1, 2013 Judge Susan B. Forsling will retire from State Court, Division F. We wish her the best in as she starts a new chapter in her life.

July 1-5, 2013 no criminal calendars, including traffic will be held in either Magistrate or State Court. During this time all Justice Partners will be transitioning to its new case management system, and court personnel will not have access to case information during this time. Who has to appear for jury duty?  

Georgia Law requires all persons summoned for jury duty to appear for service provided that they are 18 years of age, a citizen of the United States and a resident of Fulton County.

Any person who has committed a felony can serve provided their rights have been restored. If you are in doubt as to whether your rights have been restored, you should contact the Pardons and Parole office in the state in which you were convicted.

What if …….?  

I have my vacation planned for the week I am summoned.
My business has me scheduled for training.
I have a doctor’s appointment.
I have surgery scheduled.
I am a caregiver.
I don’t have transportation.

A one time deferral can be given under these circumstances, in order for you to make some arrangements, although some documentation may be required, provided our office is contacted at least ten (10) days prior to your jury service date. Our office will attempt to schedule a more convenient date for you to the best of our ability; however, none of the above situations are grounds for jury exemption under Georgia Law. Requests may be submitted in writing to: Fulton County State Court, Office of the Jury Clerk, T7100 Justice Center Tower, 185 Central Avenue, S.W., Atlanta, Georgia 30303.

If you have a medical problem, you must submit an affidavit from your doctor. Please complete the medical affidavit located on the lower right side of your jury summons.

What if I don’t have child care for my children?  

If you are the sole caregiver of your own child(ren) and he/she/they are 6 years of age or younger, and do not have an alternative form of child care you may submit a one-time affidavit and you will be excused from serving.

What if I home school my children?  

If you are the primary teacher for a home-study program, you may request that your jury service be deferred until the next school break. Please complete the required affidavit in its entirety including the dates of your next week long breaks (i.e., Summer, Spring, Christmas break, etc.) and your jury service will be rescheduled. This is a one-time deferment.

What if I am the primary caregiver for someone over the age of six?  

If you are the primary, unpaid caregiver for someone over the age of six, you must submit an affidavit that includes a medical affidavit which must be completed by the patient’s physician.

I am full-time college student.  Do I still need to serve?  

You must complete a student affidavit or submit a notarized certificate of enrollment from the Registrar’s office at your college or university. Please complete the form in its entirety including the dates of your next week long breaks. (i.e. Summer, Spring, Christmas break) and you will be deferred until one of those weeks.

Except in extreme emergencies, no deferments are permitted on the morning you are to report for jury service.

I have moved from Fulton County, what do I do?  

If you are not a resident of Fulton County, proof of your permanent address must be submitted. A voter’s registration card, driver’s license or some other official document will suffice. Mail to the address listed above or fax to 404-893-2686.

How long is Jury Service?  

Depending on the trial, jury service can last between one day and one week. However, if you are participating in a trial, and the trial is not completed by the end of the week, you will be required to report the following week until the trial is completed. You should plan to attend every week day Monday thru Friday. You will be given specific instructions on a daily basis from the assigned court..

What is the proper attire?  

Please use good judgment and report for jury duty properly dressed. Shorts, mini-skirts, hats, sweat pants, tank tops are inappropriate attire. Please do not wear uniforms, especially those with badges and name plates.

How much am I paid?  

Fulton County pays a per diem of $25 for each day of service.

What if I don’t understand or speak English?  

You will have to appear. This is not an exemption provided by Georgia Law.

What if I am not a citizen of the United States?  

You will have to furnish documentation that you are not a citizen.

How can I be exempt from jury duty?  

  Forms:
  

-- If you are 70 years of age or older, you can complete the age affidavit on the summons form to receive an exemption. (Please note that your signature must be notarized.)

-- If you are permanently physically or mentally disabled, your physician must complete the medical affidavit portion of the summons. You will be exempted once the affidavit is returned to our office.

-- If you are the primary caregiver having active care and custody of a child under six years of age, please
call 404-613-5099 to request an exemption affidavit.

-- Full-time college students may request an exemption affidavit located in the forms dropdown above.

How do I submit a postponement request?  

Postponement requests must be submitted in writing to the Office of the Jury Clerk, Fulton County State Court, 185 Central Avenue, S. W., Room T-7100, Atlanta, Georgia, 30303. This request must be received ten (10) days prior to the service date. Only one postponement request will be considered and is granted at the discretion of the court. You will be notified of the Court's decision by mail.

Is standby status information available prior to 5:00 p.m. the day before my jury service date?  

The Court can confirm jury requests until 4:30 p.m. of the day prior to your service date. At that time a determination is made as to which groups must report for service. Once the decision is made, the recording is updated.

Are cell phones and laptops permitted in the assembly room?  

Laptops are permitted in the assembly room, but, electrical outlets are limited. We ask that jurors who need to use cell phones step outside of the Jury Assembly Room as a courtesy to fellow jurors.

May I serve jury duty if I am no longer a resident of Fulton County?  

You must be a current resident of Fulton County to serve jury duty. Please submit proof of your permanent residence by mail to the Office of the Jury Clerk, Fulton County State Court, 185 Central Avenue, S.W., Room T-7100, Atlanta, Georgia, 30303, or faxed to 404-893-2686. A copy of your driver's license, voter registration card, signed tag receipt, or a utility bill reflecting your name and address is acceptable as proof of your new residence
